Disclaimer and Terms

WE SEEK TO PROVIDE A LOW COST LEGAL DOCUMENT PREPARATION SERVICE.  It is a distressing fact in our nation that a vast number of persons are unable to afford the hiring of an attorney to obtain the legal benefits afforded those who can afford legal representation.  Accordingly, it is in the interest of the public to have inexpensive resources which enable them represent themselves in obtaining these legal benefits.  We seek to provide our customers with reasonably priced tools to assist them when representing themselves to gain  in legal benefits or relief (related to bankruptcy, Divorce, adoption, etc.) These tools include the completion of legal document templates and providing lay person authored general information regarding legal procedures associated with the documents. Our mission is to accurately and efficiently complete legal forms to facilitate you representing yourself in your own case --filing as your own attorney in what the legal system calls "in pro se" or "in pro per". 

YOUR FEE COVERS ONLY THE COST OF PRODUCTION OF DOCUMENTS FOR FILING - Other costs associated with your case, including court filing fees, legal publication fees, or any other costs associated with the filing or proceeding with your legal matter are not included in our service. Almost always, you should plan on paying an additional filing fee to your local court for the filing of your case.  This fee varies from court to court.

WE PUBLISH WRITINGS REGARDING GENERALLY APPLICABLE LAW AND PROCEDURE: As lay persons to the law we assert that the First Amendment to the Constitution permits us to author and sell articles and discussions regarding the law as generally applied to citizens of a particular jurisdiction.  However, we view ourselves restricted from providing any particular person or customer with an analysis of particular laws applied to their unique factual situation.  Therefore, by agreeing to our service you agree that the provision of our services will not be considered to include such advice, and , you agree that if you discern any such legal advice being provided you by any representative of our company you agree to completely disregard this information, to treat it as mistakenly or inadvertently provided by RapidLaw representatives and not part of the service paid for by you, and to treat the information as completely unreliable as a source of legal advice.

SOMETIMES YOU NEED AN ATTORNEY: If you perceive a need for legal advice to assist you in determining how law applies to your own particular factual situation, we can refer you to a low cost attorney and do encourage you to seek out an attorney with or without reference.

YOUR DUTY NOT TO RELY ON OUR CHOICE OF DOCUMENTS AND YOUR RIGHT TO REFUND UNDER SPECIFIED CIRCUMSTANCES:  In some jurisdictions in the United States our company may not be permitted to cause you to rely on our choice of documents for your legally related purpose --as this is viewed by some of these jurisdictions as providing legal advice, (a service only attorneys may provide). We seek to comply with this legal restriction as follows: You, by agreeing to accept our service, stipulate and agree that upon the first to occur of: (1) five days of receiving documents we have prepared for you, or (2) prior to your filing, you alone or with the advice of an attorney are responsible to ascertain whether the documents we provided you are appropriate for use in your legal matter. In order to process a refund, it must be according to the following paragraph.

 HOW TO EXERCISE RIGHT TO REJECT THE DOCUMENTS AND OBTAIN A REFUND:  If, you reasonably and good faith determine within the time frame provided above that the documents provided by us to you are inappropriate for use by you in your legal matter, you agree to contact us via e-mail regarding this circumstance within this specified time frame with an explanation of why and how the documents are inappropriate for use in your matter according to your analysis of the law as it applies to your case. In the event you provide us with this information we have the right to remedy the error within 48 hours.  In the event you provide us with this notice and reasonable explanation within the specified time and we do not remedy the error within 48 hours, we agree to immediately refund fees paid to us by you for preparation of the documents you reasonably perceived as inappropriate for your use.  If you secure this refund you also agree that you are forbidden to employ the documents we provided you for any purpose whatsoever and agree to destroy the digital file provided to you by us including printings from the digital file containing your legal documents.  We will retain the right to monitor, via reasonable means, whether the documents have been employed by you after obtaining this refund.

PLACE OF SOLICITATION AND SERVICE:  Another matter of debate in certain jurisdictions is from and to where internet services are to be considered solicited and rendered. Accordingly, in an attempt to resolve this issue amongst us and our clients we require a stipulation regarding this subject.  By the act of choosing to have us perform services to you, you stipulate and agree that you are requesting and seeking our services from us at our physical location. You also stipulate and agree that the product of our services are initiated, performed, completed and provided to you specifically at the locality of our physical offices and its representative persons and in and from no other locality.  We stipulate and agree that our company in its solicitation and provision of service is not to be considered or found by anyone or any jurisdiction to be virtually present in any location whatsoever, but shall only be considered to have occurred at the place of our physical offices.  You further stipulate and agree that in the event of any dispute or analysis regarding the law relative to our relationship or the provision of our services, the only law and choice of law governing any such dispute or analysis shall be that which is applied by the local and state and Federal government in the specific real estate based locality of those individual human persons of our company which provided you with the services provided you by our company as if you were physically present before our representatives in our physical real property premises when learning of, requesting and being provided these services.  Currently we are solely located in the State of Arizona.

DOCUMENTS ARE INTELLECTUAL PROPERTY OF RAPIDLAW:  Are documents are provided you for use in one individual legal proceeding involving you.  You agree that these documents are the intellectual property of RapidLaw and you will not provide these documents or in any way facilitate their use in any manner other than in the singular legal matter for which the documents we prepared for you were produced.
